These Terms & Conditions ("Terms") govern your access to and use of SellSmart, including the mobile application and website (together, the "Service"), operated by ApexSof Solutions ("we", "us", or "our").

By creating an account or using SellSmart, you agree to these Terms and our Privacy Policy. If you do not agree, do not use the Service.

SellSmart is intended for mobile shop owners, staff, and related business users who are at least 18 years old (or the age of majority in your jurisdiction).

If you use SellSmart on behalf of a business, you represent that you have authority to bind that business to these Terms.

SellSmart helps shops manage inventory (including IMEI-tracked stock), purchases, sales, sold-out records, history, reports, settings, and stolen-device alerts (including Safe Scan). The same Firebase-backed account data may be accessed from the mobile app and the web dashboard.

Features may change over time. We may update, suspend, or discontinue parts of the Service with reasonable notice when practicable. We do not guarantee that every feature will remain available indefinitely.

You must provide accurate registration information and keep it updated. You are responsible for maintaining the confidentiality of your login credentials and for all activity under your account.

Notify us promptly at info@apexsofsolution.com if you suspect unauthorized access. We may suspend accounts that appear compromised or that violate these Terms.

You retain ownership of the business data you enter (stock records, IMEI numbers, images, purchase and sale details, buyer information you choose to store, alerts, and shop profile information).

You grant ApexSof Solutions a limited license to host, process, transmit, and display that data solely to operate SellSmart for you and to enable features you use (for example, indexing an IMEI for Safe Scan when you create an alert, or syncing data between web and mobile).

You represent that you have the right to submit the data you enter, that it is accurate to the best of your knowledge, and that storing or sharing it through SellSmart does not violate applicable law or third-party rights.

Safe Scan and stolen-alert features rely on information reported by SellSmart users. Results are informational only and do not constitute legal advice, ownership verification, police reporting, or a guarantee of device status.

You must not create false, malicious, harassing, or abusive alerts. You must not use Safe Scan to harass individuals or to process personal data unlawfully. Misuse may result in suspension or termination of your account, and we may remove abusive alert content.

You acknowledge that purchasing decisions based on Safe Scan results remain your responsibility. Always apply your own due diligence before buying or selling a device.

You agree not to:

• Misuse the Service or attempt unauthorized access to accounts or systems
• Disrupt other users, scrape data at scale without permission, or reverse engineer the Service except where allowed by law
• Upload malware or unlawful, infringing, or deceptive content
• Use SellSmart for money laundering, fraud, or other unlawful activity
• Impersonate another person or shop

Current starter access may be offered free of charge. We may introduce paid plans or usage limits later. Any pricing or plan changes that apply to your account will be communicated clearly before they take effect.

SellSmart, including its name, logos, software, design, and documentation, is owned by ApexSof Solutions or its licensors. These Terms do not grant you ownership of the Service. You may not copy, modify, or redistribute our branding or software except as expressly allowed.

The Service is provided "as is" and "as available". To the fullest extent permitted by law, ApexSof Solutions disclaims warranties of merchantability, fitness for a particular purpose, and non-infringement.

We do not warrant uninterrupted or error-free operation, that data will never be lost, or that Safe Scan results will always be complete, accurate, or current.

To the fullest extent permitted by law, ApexSof Solutions will not be liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits, lost data, lost inventory value, or business interruption arising from your use of SellSmart — including reliance on Safe Scan results.

Our aggregate liability for claims relating to the Service will not exceed the greater of (a) amounts you paid us for the Service in the 12 months before the claim, or (b) PKR 5,000.

You agree to defend and indemnify ApexSof Solutions against claims, damages, and expenses arising from your shop data, your alerts, your misuse of Safe Scan, or your violation of these Terms or applicable law — except to the extent caused by our willful misconduct.

You may request account deletion through the app or the Delete Account page on our website. After a request is confirmed, we process removal of account data according to our Privacy Policy (typically within 90 days from active systems).

These Terms are governed by the laws of Pakistan, without regard to conflict of law principles, unless mandatory consumer protections in your country require otherwise. Courts in Pakistan shall have jurisdiction over disputes arising from these Terms, subject to any non-waivable rights you may have.

We may update these Terms from time to time. Updated Terms will be posted on this page (and may also appear in the app) with a revised effective date. Continued use of SellSmart after changes become effective constitutes acceptance of the updated Terms.
